Helping  Defective Product Injury Victims

You expect the products that you use to work. You follow instructions and rely on these products to better your life. Unfortunately, a defective product can cause an injury and make your life worse. When products are defective or dangerous, unsuspecting consumers like yourself may be injured. Although no amount of money can completely erase the experience of being injured by a defective product, you may be able to recover compensation from the manufacturer responsible for the incident.

At The Carey Firm, our attorney will fight to help you recover compensation and hold the responsible manufacturers and distributors accountable.

Types of Product Liability Cases

In the state of New York, all manufacturers are required to make sure that their products are reasonably safe for consumers when used properly. Unfortunately, not all manufacturers follow this rule.

Three main types of product liability cases exist:

Defective Product Design

In a defective product design case, the injury occurs because the manufacturer’s design of the product included a flaw that made the product dangerous when used properly. In such cases, you must be able to show that a reasonable manufacturer would have known that the product’s design was unsafe.

Manufacturing Flaws

In cases involving manufacturing flaws, the product’s design isn’t unsafe. Instead, a problem occurred during the manufacturing process that led to the release of a defective product that caused your injuries. Manufacturers are required by law to inspect products for defects and repair or destroy defective products. If the manufacturer releases a defective product for sale and you are injured as a result, you may be able to file a product liability claim.

Manufacturer’s Failure to Warn

In some cases, a product is designed and manufactured properly but still includes certain safety hazards. Under New York law, manufacturers are required to label these products with a clear warning to protect consumers. If a manufacturer fails to include this label and you are injured while using the product, you may be entitled to compensation.
